- Bills, benefits, and property matters stall
- A guardianship court may end up deciding
THE DEMERSON FIRMPlan today. Protect tomorrow.Questions?346-344-2007Texas Incapacity Planning
Five attorney-prepared documents that let the people you trust make medical and financial decisions when you cannot. Completed virtually, anywhere in Texas, for one flat fee.
Services are available to approved Texas clients after conflict and eligibility review. Payment is collected only after the firm accepts the engagement.
Watch how one decision changes what happens when a parent can no longer act for himself.
Why this matters
When a stroke, accident, or diagnosis takes your voice, “next of kin” is not a legal plan. Without signed documents, the people closest to you can be locked out — exactly when minutes matter.

Your incapacity bundle
Each document answers a different question your family may face. Together, they create a practical plan for medical, financial, and personal decisions.
Choose someone you trust to make healthcare decisions if you cannot communicate or decide for yourself.
Authorize a trusted person to handle financial, legal, and property matters during incapacity.
Allow designated loved ones to receive medical information from doctors, hospitals, and providers.
Put your wishes about life-sustaining treatment and end-of-life medical decisions in writing.
State who you would want a court to appoint if guardianship ever becomes necessary.
Straightforward flat-fee pricing
A private virtual attorney consultation is included with purchase. No hourly billing, no surprise invoices.
Individual Incapacity Bundle
One complete set of 5 documents
FOR COUPLES
Couples Incapacity Bundle
Two complete sets — 10 documents total
Selecting a bundle begins the screening process — it does not charge you. Payment is collected only after the firm accepts the engagement.
The Couples Bundle requires both clients to consent to joint representation. If joint representation is not appropriate, the firm will discuss available alternatives before accepting payment.
Before you commit
Most people expect a law firm to take their money first and explain later. This works the other way around — and the terms are published before you spend anything.
Not a form generator and not a template you fill in alone. The documents are drafted by an attorney licensed by the State Bar of Texas for use under Texas law.
Screening and the firm's conflict review come first. If the firm cannot accept your matter, no payment is collected at all.
Exact percentages at every stage, in writing, up front. You will know what you get back and when before any money changes hands.
$300 individual, $500 couples. No hourly billing, no retainer draw-down, and no invoice you did not expect.
The bundle price is an advance flat fee earned in stages. These figures come straight from the firm’s written engagement terms.
| If the engagement ends… | Individual | Couples | Refunded |
|---|---|---|---|
| Before your consultation | $300 | $500 | 100% |
| After the consultation, before drafts | $210 | $350 | 70% |
| After initial drafts are delivered | $60 | $100 | 20% |
After final documents are delivered, the fee is fully earned and no refund is scheduled, except as required by law or applicable professional obligations. Approved refunds are ordinarily returned to the original payment method within 10 business days.
How it works
Individual or couples — the flat fee is shown up front.
A few yes/no questions. The firm reviews and confirms acceptance in writing.
Each client signs electronically. Couples give informed consent to joint representation.
Collected only after the firm accepts your matter.
Complete intake, meet your attorney virtually, approve your documents, and follow the signing instructions.
Take the first step
Answer a few yes/no questions. If everything checks out, the firm moves straight to your engagement paperwork. If anything needs a closer look, an attorney reviews it personally.
Do not include medical details or family history here. The firm requests more information only after its preliminary conflict review.
The included virtual consultation is scheduled after your matter is accepted, the engagement agreement is signed, and payment is made.
Common questions
Yes. A private virtual attorney consultation is included with purchase. It is scheduled after eligibility review, engagement, and payment.
Only after the firm completes its conflict and eligibility review, you sign the engagement agreement, and the firm confirms acceptance in writing. Selecting a bundle starts the screening process — it does not charge you.
The bundle price is an advance flat fee earned in stages. If the engagement ends early, the unearned portion is refunded: 100% before your consultation, 70% after the consultation but before initial drafts, and 20% after drafts are delivered. Approved refunds are ordinarily returned within 10 business days.
Yes. The service is designed for eligible Texas clients and is completed virtually, so an in-person office visit is not required.
Each spouse receives an individual set of all five documents — ten documents total. Both clients must consent to joint representation, and the firm must first confirm that joint representation is appropriate.
Timing depends on completion of intake, the consultation, and the complexity of your instructions. You will receive the expected schedule when the firm accepts the matter.
If a conflict or eligibility issue prevents the firm from accepting the matter, no attorney-client relationship is formed and no payment is collected. Any payment collected in error is refunded in full.
The right time to plan is before the crisis.
